Rape
Rape is self-explanatory. However, false or exaggerated accusations frequently occur. In every case, the accused should seek the advice of an experienced defense attorney.
Rape and similar sex charges often carry significant penalties as well as a negative social stigma.
Legal Definitions of Rape and Sexual Assault
Rape is defined as non-consensual penetration whether vaginal, anal, or oral. The penetration can be made by anthing in order for rape to be charged. Penetration may be by a body part including a finger or an object. The penetration may be forced as with threats of violence or other physical means. But any sexual act may be considered "forceable" or non-consensual due exclusively to the alleged victim's age.
A sexual assault is generally the unwanted sexual contact that stopping short of penetration. Unwanted sexual touching is considered a sexual assault.
