Child Molestation
Child molestation is a crime in every state, and those accused of child molestation come from every walk of life.
Unfortunately, just being arrested for child molestation, other sexual offense or just being under investigation for such a crime can cause the accused person to suffer a severely damaged reputation. In contrast to other crimes, our societal response is one of revulsion just for the accusation alone and people tend assume someone connected with a child molestation charge or sex crime is guilty until proven innocent. Sometimes, people are found guilty by a jury despite being proven innocent years later by DNA evidence, recanted testimony or both.

What to Do If You've Been Arrested
If you have been arrested or taken into police custody regarding child molestation or any sex crime:
- Do not resist being arrested. Do not argue, do not try to explain anything. Do not offer information. Anything you say can be used against you in court. Count on it.
- Ask if you are under arrest, and whether you can leave. If you can leave, leave immediately. Don't say another word.
- If you cannot leave, say that you will not speak to the police unitl you see a lawyer.
- Tell the police only your name and address. This is the only information you must give them.
- In the United States, police are allowed to lie to you to get information. NO matter what they may tell you or how politely they treat you, they are not trying to help you. If they tell you that this is your chance to tell your side of the story, don't take the bait. They want to talk. There are many cases where the police will tell you that a co-defendant arrested with you already confessed and gave you up so you may as well talk and save yourself. Again, do not take the bait! Keep quiet. Demand your lawyer. Be clear about it. Don't ask, "What if I want a lawyer?" That is NOT demanding an attorney. You MUST invoke your absolute right to have an attorney present before you say anything or sign anything.
- You do not have to give the police an alibi, or discuss your whereabouts at any given time.
- Stay calm.
- You can ask what you are being charged with but DO NOT begin a converstation or spontaneously say ANYTHING.
- Do not consent to any search. If a police officer says he has a search warrant, ask for a copy. If the officer says they will just get a search warrant anyway, so you may as well consent to a search, tell them to get a warrant.
- If a valid search warrant is shown, you must allow the search and you cannot and must not interfere with it.
- Contact a criminal defense attorney immediately, preferably one with experience defending against child molestation charges or sex crime charges.
Never sign anything voluntarily. If you feel that you are being forced to sign something, or initial something, write the words, "I want my lawyer" instead of writing your signature next to every single place you're being pressured to sign or initial.
After an arrest for child molestation or after being released from police custody, Do NOT have make any excuses to anyone or any statements about the situation. You should not make any statements, oral or written, regarding why you were arrested to ANYONE. ANYTHING you say to other people can later be presented against you in a courtroom. Do not speak to any media representatives or reporters if your situation has leaked to the media.
